In a lease contract when project achieved for 3 hotels complex, the leaseholder has terminated his contract when the contractor in charge of the engineering and construction announced additional delays for the completion by 5.5 months.
The leaseholder requested from the International Commerce Chamber the opening of an arbitration proceeding during which the contractor said that all delays are under the leaseholder’s responsibility and the termination is excessive.
In this arbitration context the leaseholder appointed Argos Construction as expert in order to present an independent opinion on the situation and the forecasting for the completion at the termination date.
Argos Construction succeeded to rebuild the story of the project within a difficult context lying on few information. This enabled to conclude that the completion date of the hotel would have had an additional delay of 6 months to the contractor’s forecasting and the critical delays are under the contractor’s responsibility.
After our report, the parties have finally found a settlement agreement.
